What are Unenforceable Credit Agreements?
The 1974 Consumer Credit Act was brought in for the protection of consumers, it gave the rules for lenders to adhere to when they issued consumer credit agreements.The act also established that if a lender did not follow the letter of the law the credit agreement would be rendered unenforceable and the borrower would no longer be liable for the debt without an order of the court.
Recent high profile court cases have highlighted that lenders may not have been following the rules of the act when they have laid out their credit agreements.
